Namun, masing-masing ibu dan ayah wajib mengambil cuti 90 hari yang diberikan khusus untuknya. Jika tak mengambil cuti wajib ini, jumlah hari cuti tidak bisa ditransfer ke pasangannya. Sementara, orang tua tunggal berhak atas cuti 480 hari penuh. Seperti diketahui di Indonesia Dewan Perwakilan Rakyat Daerah (DPR) RI tengah menggodok Rancangan Undang-Undang (RUU) Kesejahteraan Ibu dan Anak (KIA), dimana salah satu poinnya mengatur soal kebijakan cuti ayah selama 40 hari. DPR beralasan, pasal tersebut bertujuan demi kesejahteraan ibu dan anak dapat tercapai sesuai dengan tujuan pembangunan nasional. Salah satu ganjalan yang ada pada aturan lama adalah ayah hanya diberikan waktu lima hari untuk mendapatkan cuti kerja selama kelahiran anak.
